The following terms and conditions apply to students enrolling in MOVE Education online and onsite courses and post craduate training.

Reservation and Payment
To reserve your place on the course please complete the booking form and submit it through the booking system. Payments must be made by credit card. MOVE Education use a third party payment gateway eWay which will process payment on a secure site. Payment by direct transfer, cheque or cash are not available. Final payment will be made upon booking. For reservations made within 7 days of the course commencement date, full payment is required when the reservation is accepted. If payment of the balance of the course price is not received by Company by the required time we will assume that you will not be participating in the course and cancellation charges in accordance with Section 3 will apply.

Deposits and Payment Plans
Deposits for courses can be made by Direct Deposit only or email hello@moveeducation.com.au for credit card deposits. Payment Plans are available, please email hello@moveeducation.com.au.

Tuition Fees
Fees must be paid on enrolment or a payment plan. If an invoice is issued by MOVE Education it must be paid no later than 14 days from the date of the invoice. Payment can be made via electronic funds transfer, credit card or bank draft or other pre-approved payment method.

Withdrawing from  a Course
If a student wishes to withdraw from a unit of study or their entire course they will forfeit the cost of the course.

Special Circumstances
MOVE Education will review its refund policy in cases of special circumstances. Special circumstances include:

  • Medical circumstances: where a student’s medical condition has changed to such an extent that he or she is unable attend face to face classes and/or study online, or
  • Family/Personal circumstances: death or severe medical problems within a family, or unforeseen family financial difficulties, so that it is unreasonable to expect a student to attend and/or study online

Evidence sufficient for a claim of special circumstances shall include (but is not limited to) the following:

  • In respect to medical circumstances, the provision of a medical certificate from a medical practitioner
  • In respect to family/personal circumstances, a statutory declaration witnessed by a Justice of the Peace, and where family medical problems are cited, a copy of a medical certificate from a medical practitioner

MOVE Education will be satisfied that a student’s circumstances are beyond the student’s control if a situation occurs that a reasonable person would consider is not due to the person’s action or inaction, either direct or indirect, and for which the student is not responsible. The situation must be unusual, uncommon or abnormal.

Each review will be examined and determined on its merits by considering a student’s claim together with independent supporting documentation substantiating the claim.

Deferring
Derring the course is currently not permitted.

Transfers
Requests for transfers to alternate courses can be arranged if MOVE Education is advised in writing by sending an email to info@moveeducation.com.au. These requests must be made 10 or more working days prior to the course commencement date and is subject to availability on a future course. All transfers will attract an administration charge of $55.00 (incl. GST).

Non Attendance (No Show)
If a student fails to attend a course in its entirety, course fees will not be refunded or allocated to another course. Students are required to attend all lectures. Should the student miss a lecture they will be required to make up the time with off-site homework to accrue the relevant number of hours. For the Level 2 150 Hour Mastery of Yoga teaching a maximum of 2 lectures may be missed. If over 2 lectures are missed, the student will be required to re-sit those lectures in he next training and will not be issued with a certificate of completion until those lecture and the final assessment has been completed.

Goods and Services Tax (GST)
Advertised prices are GST inclusive. The portion of the program or qualification fee attributable to the education component is GST free, however in accordance with GST legislation MOVE Education is required to charge GST on the portion of the program that relates to catering. Tax invoices that comply with GST legislation will be issued for all enrolments. The amount of GST will be separately identified on all tax invoices.

General

  • MOVE Education reserves the right to cancel, postpone or re-schedule courses due to low enrolments or unforeseen circumstances. Where a fee refund is due to a student such a refund will be provided within 30 days.
  • The information provided by MOVE Education is correct at the time of publication but may be subject to change. MOVE Education reserves the right to change course fees, dates, content or facilitators at its discretion.
  • MOVE Education reserves the right to record, via video and/or audio, learning sessions for quality assurance purposes and to support students.

Cancellations.
If you wish to cancel the course you must notify MOVE Education in writing. Once we’ve received your notice, cancellation will take effect subject to the following: If cancellation takes place more than 30 days prior to course commencement, any payments made will be refunded minus your deposit. If cancellation takes place 14 days prior to your course start date, 50% of the course price will be forfeited. If cancellation takes place less than 7 days prior to your course start date, 100% of the course price will be forfeited.

Health and Fitness Requirements.
You must be in good physical and mental health to participate in the course. You are advised to consult with a physician to ensure that you are in adequate health to safely participate in the course. Additionally, MOVE Education and the course leader reserve the right in their absolute discretion to refuse a participant the right to participate in a course on medical or fitness grounds.

 Cancellation Due to Course Booking Numbers.
MOVE Education reserves the right to cancel any course prior to commencement in the event that there are too few people booked in which case you will be given a full refund of any and all payments made to MOVE Education. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation.

Changes, Postponement, Cancellation or Delay.
MOVE Education reserves the right to make changes to any aspect of the course if, in the absolute discretion of MOVE Education, it is necessary to do so due to conditions that may be hazardous or dangerous or due to any other adverse or threatening conditions such as weather, political, military, terrorist or otherwise or for any other reason considered necessary by MOVE Education. If the designated course leader is unable to lead the lecture for any reason, MOVE Education, in its discretion, will enlist another teacher of substantially similar qualifications to lead the lecture. In the event of any change, postponement, cancellation, or delay, you acknowledge that you will have no right of refund of the course price in whole or in part and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement or delay.

Photography.
MOVE Education reserves the right to use photographs or videos from the escape for promotional purposes. By making a reservation with MOVE Education, you agree to allow your image to be used in such photography. If you prefer that your image not be used, please notify MOVE Education in writing before the escape commences and we will not use your image.

Force Majeure.
If MOVE Education and the course leader are prevented from performing any of their obligations under this Agreement by acts of God, strikes, trade disputes, natural disasters, tsunami, volcano eruptions, fire, weather, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside MOVE Education and the course leader’s reasonable control, MOVE Education and the course leader will be under no liability whatsoever to you and may either cancel or postpone the course.

Release and Waiver of Liability.
You release, waive, discharge, hold harmless and agree to indemnify Company, its officers, its employees, its agents, its licensees, teachers, independent contractors, other representatives, and course leaders  (the “Released Parties”) from all claims, actions or losses for personal injury, illness, emotional trauma, property damage, wrongful death, loss of services, loss of profits, as well as consequential, exemplary, indirect or punitive damages or otherwise that you may occur in connection with your participation in the course and any extra activities you may engage in during the course whether or not sponsored by the MOVE Education (“Claims”). You waive any Claims you have, or may at any time have, against the Released Parties and you agree not to make any Claim against any Released Party. You will be required to sign a copy of this waiver prior to departure.
